Terms of Service

Section 01

Acceptance of Terms

By enrolling a camper in Laughter School, submitting a registration form, making a payment, or accessing our website at www.laughterschool.com (the "Site"), you ("Parent," "Guardian," or "you") agree to be legally bound by these Terms of Service ("Terms") on behalf of yourself and the minor camper in your care.

If you do not agree to these Terms in their entirety, do not enroll your camper or use our services.

These Terms constitute a legally binding agreement between you and Laughter School. Please read them carefully before completing enrollment. For purposes of these Terms, "camper" refers to the minor child being enrolled; "you" or "parent/guardian" refers to the adult completing enrollment; and "Services" refers to all camp programming, activities, communications, and related offerings provided by Laughter School.

Section 03

Eligibility & Enrollment

Age Requirement

Laughter School camps are designed for teens between the ages of 13 and 18, inclusive. Campers must meet the minimum age of 13 years old by the first day of the enrolled session. Campers who turn 19 during a session may complete that session.

Parental / Guardian Consent Required

All campers are minors. Enrollment must be completed by a parent or legal guardian who is at least 18 years of age. By completing enrollment, you represent and warrant that: (a) you are the parent or legal guardian of the camper; (b) you have the legal authority to enter into this agreement on behalf of the camper; (c) all information provided during enrollment is accurate and complete; and (d) you have read, understood, and agree to these Terms in full.

Enrollment Confirmation

Enrollment is not confirmed until full payment or the first installment of a payment plan has been received and processed. A confirmation email will be sent to the address provided at enrollment.

Capacity

Each session is limited to 24 campers. Spots are reserved on a first-paid, first-confirmed basis. Laughter School reserves the right to place applicants on a waitlist if a session is at capacity.

Laughter School's Right to Refuse or Remove

Laughter School reserves the right to refuse enrollment or remove a camper from a session at its sole discretion, including but not limited to situations involving safety concerns, misrepresentation on enrollment forms, or failure to comply with camp rules. In such cases, a prorated refund may be issued at Laughter School's discretion.


Section 04

Fees, Payment & Payment Plans

Tuition Fees

Current tuition fees are displayed on the Laughter School website and enrollment pages. Fees are subject to change between sessions. The fee in effect at the time of your enrollment confirmation applies to that session.

Payment Options
Option Description
Pay in Full Full tuition paid at the time of enrollment. Lowest total cost.
Payment Plan A split-payment arrangement as described on the enrollment page. First installment due at enrollment; subsequent installments automatically charged on the schedule disclosed at enrollment.
Payment Authorization

By selecting a payment plan, you authorize Laughter School and its payment processor to automatically charge the payment method provided for all installments on the scheduled dates. It is your responsibility to ensure your payment method remains valid and has sufficient funds.

Failed Payments

If an automatic payment fails, Laughter School will attempt to notify you by email. If payment is not resolved within 5 business days of the failed attempt, Laughter School reserves the right to cancel the enrollment and forfeit the reserved spot. Any amounts already paid may be subject to the refund policy in Section 5.

Payment Security

Payments are processed by a third-party PCI-DSS compliant payment processor. Laughter School does not store full credit card or debit card numbers.


Section 05

Cancellation & Refund Policy

Timing Refund
More than 30 days before camp Full refund of all amounts paid, less any non-refundable processing fees charged by the payment processor.
15 to 30 days before camp 50% refund of total tuition paid.
Fewer than 14 days before camp No refund. You may transfer your camper's spot to another eligible teen at no charge. Transfer requests must be submitted in writing to [email protected].
Early Departure

No refund or pro-ration will be provided for early departure from a session, including voluntary withdrawal, illness, or removal for conduct violations, except at the sole discretion of Laughter School.

Satisfaction Guarantee
🛡️ Our Promise If a camper attends all four (4) days of their enrolled session and you do not believe the experience delivered measurable value, you may submit a written refund request to [email protected] within 7 days of the final day of camp. Laughter School will review such requests and, at its sole discretion, may issue a full or partial refund. This guarantee is available once per family.
Cancellations by Laughter School

Laughter School reserves the right to cancel a session due to insufficient enrollment, instructor unavailability, severe weather, public health emergency, natural disaster, or other circumstances beyond its control ("Force Majeure"). In the event of a Laughter School-initiated cancellation: (a) you will be notified as soon as reasonably possible; (b) a full refund of all tuition paid will be issued within 14 business days; or (c) you may elect to transfer enrollment to a future available session at no additional charge. Laughter School is not responsible for any incidental costs incurred by families in connection with a cancelled session.

Refund Processing

Approved refunds will be returned to the original payment method within 10–14 business days of approval.


Section 06

Camp Rules & Code of Conduct

All campers are expected to conduct themselves in a manner that is safe, respectful, and conducive to a positive learning environment. By enrolling, you agree to ensure your camper understands and follows the following standards.

🤝 Respect Treat all instructors, staff, and fellow campers with dignity. Bullying, harassment, or discrimination of any kind will result in immediate removal without refund.
🛡️ Physical Safety Follow all safety instructions. Physical aggression or any behavior endangering others is strictly prohibited.
📵 Personal Devices Device use during instructional activities is at staff discretion. Campers may be asked to store devices during sessions.
🚫 Substance Policy Possession or use of alcohol, tobacco, e-cigarettes, cannabis, or any controlled substance on camp premises is strictly prohibited and will result in immediate removal without refund.
📅 Attendance Campers are expected to attend all four days. Please notify us in advance of any absence. Excessive absences may affect showcase participation.
🎒 Personal Property Campers are responsible for their personal belongings. Laughter School is not liable for lost, stolen, or damaged personal property.
Consequences

Violations of the Code of Conduct may result in a verbal warning, parent/guardian notification, suspension from activities, or removal from camp. The severity of the response is at the sole discretion of Laughter School staff.


Section 07

Health, Safety & Medical Authorization

Health Disclosure

You are required to disclose all known medical conditions, allergies, dietary restrictions, and physical limitations that may affect your camper's participation or safety. This information must be provided on the camper information form prior to the first day of camp. Failure to disclose material health information may result in removal from camp without refund.

Emergency Medical Authorization
🚑 Medical Authorization By enrolling your camper, you authorize Laughter School staff to: (a) administer or arrange for basic first aid; (b) contact emergency medical services (911) in the event of a medical emergency; and (c) take such other actions as are reasonably necessary to protect the health and safety of your camper when you cannot be reached. Laughter School is not liable for medical decisions made in good faith during an emergency when a parent or guardian cannot be promptly reached.
Illness Policy

Campers who are visibly ill, have a fever of 100.4°F or higher, or have been diagnosed with a contagious illness within 24 hours of a camp day must not attend. If a camper becomes ill during the camp day, Laughter School will contact the parent or guardian for prompt pickup.

Medication

Laughter School staff are not licensed to administer prescription medications unless a separate written authorization and instructions are provided. Over-the-counter medications will only be administered with prior written consent from the parent or guardian.

Insurance

Laughter School [does / does not] carry general liability insurance. Campers are not covered by Laughter School's insurance for personal illness or injury. Parents and guardians are encouraged to maintain their own health insurance coverage for their camper.

Texas Youth Camp Safety
⭐ Texas Compliance Laughter School operates in compliance with the Texas Youth Camp Safety and Health Act (Texas Health & Safety Code, Chapter 141) to the extent applicable to its program format and session duration.

Section 08

Photo, Video & Media Release

Consent to Record

By enrolling your camper, you grant Laughter School and its authorized representatives the right to photograph and videotape your camper during camp activities and the Day 4 showcase for the following purposes: (a) delivery to enrolled families (showcase recording and camp photos); (b) promotional and marketing use on Laughter School's website and social media channels; and (c) educational or archival purposes.

Opt-Out

If you do not consent to your camper's image being used for promotional or marketing purposes, you must notify Laughter School in writing at [email protected] before the first day of camp. Opting out of promotional use does not affect delivery of the showcase recording and camp photos to your family.

No Compensation

No compensation will be provided to you or your camper for the use of photographs or video footage.

Camper-Created Content

Any performances, scenes, scripts, or other creative works developed during camp may be recorded and distributed to enrolled families. Laughter School may use brief excerpts of such recordings for promotional purposes subject to the opt-out right described above.


Section 09

Assumption of Risk & Liability Waiver

Nature of Activities

Laughter School's programs involve physical activities including movement exercises, stage blocking, improv games, and performance activities. While Laughter School takes reasonable precautions to ensure camper safety, all physical activities carry an inherent risk of minor injury.

Assumption of Risk

By enrolling your camper, you acknowledge and agree that: (a) you understand the nature of the activities involved in Laughter School's programs; (b) you voluntarily choose to enroll your camper with knowledge of the risks involved; and (c) you assume all risks of injury, illness, or loss arising from your camper's participation, to the fullest extent permitted by Texas law.

Release of Liability
⚠️ Liability Waiver To the fullest extent permitted by applicable law, including Texas law, you hereby release, waive, discharge, and covenant not to sue Laughter School, its owners, instructors, staff, volunteers, agents, and successors (collectively, "Released Parties") from any and all claims, demands, damages, losses, costs, or expenses arising out of or related to your camper's participation in Laughter School's programs, whether caused by the negligence of the Released Parties or otherwise, except in cases of gross negligence, recklessness, or intentional misconduct.
Texas Law Notice

Under Texas law, a release of liability signed by a parent or guardian on behalf of a minor may be enforceable in certain circumstances. You acknowledge that you have had the opportunity to consult with an attorney before agreeing to these Terms and that you are agreeing to this release voluntarily and with full understanding of its legal effect.


Section 10

Indemnification

You agree to indemnify, defend, and hold harmless Laughter School and its owners, instructors, staff, agents, and successors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or related to:

(a) Your breach of these Terms;
(b) Your camper's violation of the Code of Conduct;
(c) Any inaccuracy or omission in information you provided during enrollment;
(d) Any act or omission by you or your camper that causes injury to a third party or damage to property; or
(e) Your violation of any applicable law or regulation.


Section 11

Intellectual Property

All content on the Laughter School website, including but not limited to text, logos, graphics, images, curriculum materials, and camp programming, is the property of Laughter School and is protected by U.S. copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Laughter School materials without prior written consent.

Campers retain ownership of any original creative works (scripts, characters, scenes) they independently create during camp. However, Laughter School retains a limited, non-exclusive license to use brief excerpts of in-camp performances for promotional purposes as described in Section 8.


Section 12

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LAUGHTER SCHOOL'S TOTAL LIABILITY TO YOU OR YOUR CAMPER FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES, WHETHER IN CONTRACT, TORT, OR OTHERWISE, SHALL NOT EXCEED THE TOTAL AMOUNT OF TUITION FEES PAID BY YOU FOR THE SPECIFIC SESSION GIVING RISE TO THE CLAIM.
IN NO EVENT SHALL LAUGHTER SCHOOL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, OR LOSS OF GOODWILL, EVEN IF LAUGHTER SCHOOL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some states do not allow the exclusion or limitation of certain damages. If applicable law in your jurisdiction does not allow these limitations, they shall apply to the maximum extent permitted by law.


Section 13

Dispute Resolution & Governing Law

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

Venue
⭐ Dallas County Jurisdiction Any dispute, claim, or legal proceeding arising out of or related to these Terms or the Services shall be brought exclusively in the state or federal courts located in Dallas County, Texas. You consent to the personal jurisdiction of such courts.
Informal Resolution

Before initiating any formal legal proceeding, you agree to contact Laughter School in writing at [email protected] and provide a reasonable description of your dispute. Both parties agree to attempt to resolve the dispute informally within 30 days of the written notice.

Mediation

If informal resolution is unsuccessful, the parties may agree to non-binding mediation through a mutually agreed mediator in Dallas County, Texas, before pursuing litigation.

Class Action Waiver

To the fullest extent permitted by law, you agree that any dispute resolution proceeding will be conducted only on an individual basis and not in a class, consolidated, or representative action.


Section 14

Dallas County & Texas Regulatory Compliance

Texas Youth Camp Safety and Health Act

Laughter School is aware of and operates with reference to the Texas Youth Camp Safety and Health Act (Texas Health & Safety Code, Chapter 141), which governs youth camps operating in Texas. To the extent these requirements apply to Laughter School's program format and duration, Laughter School strives to comply with all applicable provisions, including those relating to health and safety standards, staff conduct, and camper supervision.

Background Checks

Laughter School requires background screening for instructors and staff who work directly with minor campers, consistent with best practices for youth-serving organizations in Texas.

Mandatory Reporting
📋 Texas Mandatory Reporting All Laughter School staff are required to comply with the Texas Mandatory Reporting Law (Texas Family Code, Section 261.101), which requires any person who has cause to believe that a child has been abused or neglected to report that belief to the Texas Department of Family and Protective Services (DFPS) or law enforcement immediately.
Dallas County Operations

Laughter School operates its in-person programs within Dallas County, Texas. All in-person activities are subject to applicable Dallas County ordinances and regulations, including any health and safety requirements in effect at the time of the session.

ADA Compliance

Laughter School is committed to providing an inclusive experience and will make reasonable accommodations for campers with disabilities, consistent with the Americans with Disabilities Act (ADA) and applicable Texas law. Accommodation requests should be submitted at least 14 days prior to the first day of camp.

Anti-Discrimination

Laughter School does not discriminate on the basis of race, color, religion, sex, national origin, disability, age, or any other characteristic protected by federal, state, or local law in its enrollment, programming, or operations.


Section 15

Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed from these Terms if modification is not possible. The remaining provisions of these Terms shall continue in full force and effect.


Section 16

Entire Agreement

These Terms, together with the Privacy Policy and any enrollment forms, payment agreements, or camper information forms completed at the time of registration, constitute the entire agreement between you and Laughter School with respect to the Services and supersede all prior or contemporaneous communications, representations, or agreements, whether written or oral, relating to the subject matter herein.

No waiver of any provision of these Terms shall be effective unless made in writing and signed by an authorized representative of Laughter School. Laughter School's failure to enforce any provision of these Terms shall not constitute a waiver of its right to enforce that provision in the future.


Section 17

Changes to These Terms

Laughter School reserves the right to update or modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this document, notify enrolled families by email where the changes affect an active enrollment, and post the updated Terms on our Site.

Your continued use of our Services after the effective date of updated Terms constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you may cancel your enrollment in accordance with Section 5.
